If the separation then proceeds to divorce, the agreement can be used as proof of the date of separation and form the basis of the court`s decisions on the division of property and responsibilities. The court has the power to amend or overturn a separation agreement because it is not legally binding. However, the court is likely to accept the agreement, provided it is fair to each spouse and all the children in the marriage and that the circumstances have not changed to make it inappropriate.
